Terms of service

Upper Beaconsfield General Store is a registered business name held by The Trustee for River Beach Trust No 1 (ABN 81 886 527 218).

Your Australian Consumer Law rights
Nothing in these terms excludes, restricts or modifies any right, guarantee, condition or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

About these terms

These Terms of Service apply when you:

  • visit or use our website;
  • purchase products from us;
  • place an online order;
  • arrange collection or delivery;
  • make a booking;
  • use our café, retail or delivery services; or
  • otherwise transact with Upper Beaconsfield General Store.

In these terms, “we”, “us” and “our” mean Upper Beaconsfield General Store, the registered business name held by The Trustee for River Beach Trust No 1.

By using our website or placing an order, you agree to these terms.

Eligibility and accurate information

You must be legally capable of entering into a contract.

You agree to provide complete, accurate and current information when placing an order, creating an account, booking a service or arranging delivery. You are responsible for checking:

  • selected products and quantities;
  • billing and delivery addresses;
  • contact details;
  • delivery instructions;
  • booking details; and
  • payment information.

Please contact us promptly if you discover an error.

Age-restricted and regulated products

Products subject to age, identification, exchange, handling or safety requirements may only be purchased and received by a person who meets those requirements.

We may request identification or refuse an order, collection or delivery where a legal or safety requirement has not been met.

Products, services and website information

We take reasonable care when preparing product descriptions, images, availability information and pricing.

Product packaging, colour, dimensions and appearance may change. Naturally variable products—including firewood, soil, mulch, garden materials and food products—may have reasonable variations in colour, size, texture, moisture, composition or appearance.

These reasonable variations do not remove your rights where a product fails to match its description or meet a consumer guarantee.

Stock and availability can change without notice.

Information published on our website is general information. It should not be treated as specialist medical, veterinary, agricultural, building, fire-safety or other professional advice. You must follow applicable laws, product labels, manufacturer instructions and safety directions.

Prices and payment

All prices are in Australian dollars and include GST where applicable unless clearly stated otherwise.

Delivery charges, service charges, deposits, cylinder charges, exchange requirements or other applicable costs will be displayed at checkout or disclosed before we accept the order.

You authorise our payment provider to process the amount shown for your purchase.

We may correct an obvious pricing, product or description error before accepting or fulfilling an order.

If payment has already been taken and we cannot fulfil the order on the corrected basis, we will offer an appropriate option, which may include cancellation and a refund.

Orders and acceptance

An automated order confirmation means that we have received your order. It does not necessarily mean that the order has been accepted.

We may accept an order by:

  • confirming that it is being prepared;
  • allocating products or delivery capacity;
  • confirming a booking or delivery;
  • dispatching the order; or
  • otherwise notifying you that it has been accepted.

We may reasonably reject or cancel an order because of:

  • insufficient stock;
  • delivery or access limitations;
  • safety concerns;
  • legal or regulatory restrictions;
  • an obvious pricing or product error;
  • suspected fraud or unauthorised payment;
  • inability to supply the requested product or service; or
  • another material operational issue.

If we cancel an order after payment has been taken, we will refund the affected amount unless you agree to an alternative such as a replacement, rescheduled delivery or store credit.

You are responsible for checking your order details and contacting us promptly about an error.

Customer cancellations

Change-of-mind and customer-requested cancellations are handled according to our Return and refund policy .

Water-delivery bookings
Water deliveries cancelled by the customer are generally rescheduled or retained as a credit for a future water delivery rather than refunded in cash. This does not limit rights or remedies available under the Australian Consumer Law.

Delivery and collection

Our Delivery, shipping and collection policy forms part of these terms and explains:

  • delivery areas and charges;
  • estimated delivery timing;
  • safe vehicle access;
  • water-delivery requirements;
  • bulk-product unloading;
  • regulated-product handover;
  • store collection; and
  • delivery problems.

You must provide accurate information about delivery access and any conditions that may affect the safety of our staff, vehicles, equipment or other people.

Our driver may refuse, postpone or stop a delivery where access is unsafe, unlawful or unsuitable.

Returns, refunds and consumer guarantees

Products and services may come with guarantees that cannot be excluded under the Australian Consumer Law.

Our Return and refund policy explains:

  • remedies for faulty, damaged, unsafe or incorrectly supplied products;
  • major and minor product failures;
  • change-of-mind purchases;
  • delivery cancellations and credits; and
  • how to request a return, refund, credit or other remedy.

Third-party services and links

Our website may use or link to third-party services, including:

  • Shopify;
  • payment providers;
  • booking and ordering platforms;
  • maps and navigation services;
  • social-media platforms;
  • delivery and logistics providers; and
  • analytics and advertising services.

Third-party services may have their own terms and privacy policies.

We are not responsible for an independently operated third-party service except to the extent required by law. We remain responsible for our own obligations to you.

Privacy

Liability

To the maximum extent permitted by law, we are not responsible for loss caused by:

  • your unlawful use of the website or products;
  • your breach of these terms;
  • inaccurate information or delivery instructions supplied by you;
  • your failure to follow product, manufacturer or safety directions; or
  • an independent third-party service outside our reasonable control.

Any exclusion or limitation of liability in these terms applies only to the extent permitted by law. We do not exclude or limit liability where doing so would be unlawful.

Changes to these terms

We may update these terms to reflect changes to our business, website, services, systems or legal obligations. Updated terms apply to future website use and future orders after publication. The terms applying to an accepted order will generally be those in effect when the order was accepted, unless a change is required by law or agreed with you.

Severability

If any provision of these terms is invalid or unenforceable, it will be read down or removed to the minimum extent necessary. The remaining provisions will continue to operate.

Governing law

These terms are governed by the laws of Victoria, Australia. Courts and tribunals with jurisdiction in Victoria may hear disputes, subject to any applicable right you have to bring a claim elsewhere.
